Agreement Overview

These Terms of Service ("Terms") constitute a legally binding agreement between you ("Client" or "You") and TaxPilot ("Company," "We," or "Us") regarding your use of our tax preparation and advisory services.

By engaging our services, creating an account, or using our platform, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

1. Acceptance of Terms

Binding Agreement

Your use of TaxPilot services constitutes acceptance of these Terms. If you do not agree with any provision, please discontinue use of our services immediately.

Capacity to Contract

  • You must be at least 18 years old to use our services
  • You have the legal capacity to enter into binding contracts
  • You are not prohibited from receiving services under applicable laws
  • All information provided during registration is accurate and complete

Updates to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated through email or platform notifications. Continued use after changes constitutes acceptance of the modified Terms.

2. Our Services

Tax Preparation Services

  • Federal and state income tax return preparation
  • Business tax return preparation for various entity types
  • Tax amendment and prior year returns
  • Electronic filing of completed returns

Advisory Services

  • Tax planning and strategy consultation
  • Year-round tax guidance and support
  • Quarterly business tax planning

Platform Services

  • Secure document upload and storage
  • Client portal access for tax documents
  • Communication tools for client-preparer interaction
  • Progress tracking and status updates

Service Limitations

Our services do not include:

  • Legal advice or representation in legal matters
  • Investment or financial planning advice
  • Bookkeeping or accounting services (unless specifically contracted)
  • Services outside our professional licensing and expertise

3. User Responsibilities

Information Accuracy

  • Complete Disclosure: Provide all relevant financial and tax information
  • Accuracy: Ensure all provided information is true, complete, and accurate
  • Documentation: Supply supporting documents as requested
  • Updates: Promptly notify us of any changes or corrections

Document Responsibilities

  • Retain original documents and records as required by law
  • Provide documents in a timely manner to meet filing deadlines
  • Ensure documents are legible and complete
  • Maintain personal copies of all submitted materials

Account Security

  • Maintain confidentiality of account credentials
  • Use strong passwords and enable two-factor authentication
  • Immediately notify us of any unauthorized access
  • Log out of shared or public computers

Communication Requirements

  • Respond promptly to requests for information or clarification
  • Use official communication channels provided by TaxPilot
  • Maintain current contact information in your account
  • Review and approve returns before electronic filing

4. Fees and Payments

Service Fees

  • Transparent Pricing: All fees are clearly disclosed before service commencement
  • Service-Specific Rates: Fees vary based on complexity and service type
  • No Hidden Charges: Additional fees will be communicated and approved in advance

Payment Terms

  • Payment Schedule: Payment is due upon completion of services unless otherwise arranged
  • Accepted Methods: Credit cards, bank transfers, and approved payment platforms
  • Currency: All fees are quoted and payable in US Dollars
  • Late Payments: Late fees may apply to overdue accounts

Refund Policy

  • Satisfaction Guarantee: 100% money-back guarantee if unsatisfied with service quality
  • Refund Period: Refund requests must be made within 30 days of service completion
  • Processing Time: Approved refunds processed within 5-10 business days

6. Limitations of Liability

Service Disclaimers

While we strive for accuracy and completeness:

  • Tax laws are subject to interpretation and change
  • Individual circumstances may affect tax outcomes
  • We rely on information provided by clients
  • Future tax law changes may affect prior returns

Liability Limitations

  • Direct Damages: Our liability is limited to the fees paid for services
  • Indirect Damages: We are not liable for consequential or punitive damages
  • Third-Party Claims: Not responsible for actions of third parties
  • Force Majeure: Not liable for delays due to circumstances beyond our control

Indemnification

Clients agree to indemnify TaxPilot against claims arising from:

  • Inaccurate or incomplete information provided by client
  • Client's failure to follow professional advice
  • Unauthorized use of our services or platform
  • Violation of these Terms or applicable laws

7. Termination

Client Termination Rights

  • Cancel services at any time with written notice
  • Request return of documents and materials
  • Receive completed work up to termination date
  • Pay for services rendered prior to termination

Company Termination Rights

We may terminate services if:

  • Client fails to provide necessary information
  • Payment obligations are not met
  • Client violates these Terms
  • Professional standards would be compromised

Effect of Termination

  • Outstanding obligations survive termination
  • Confidentiality requirements continue indefinitely
  • Document retention follows professional standards
  • Final billing and payment are due upon termination

8. Dispute Resolution

Informal Resolution

We encourage direct communication to resolve concerns:

  • Contact our client service team first
  • Escalate to management if needed
  • 30-day period for informal resolution attempts
  • Good faith efforts to reach mutually acceptable solutions

Formal Dispute Process

  • Mediation: Disputes will be submitted to binding mediation
  • Arbitration: Unresolved disputes proceed to arbitration
  • Jurisdiction: Connecticut state law governs this agreement
  • Venue: Legal proceedings in Manchester, Connecticut

Class Action Waiver

Both parties waive the right to participate in class action lawsuits related to these Terms or our services.

9. Miscellaneous Provisions

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between the parties and supersede all prior communications.

Severability

If any provision is found unenforceable, the remaining provisions continue in full force and effect.

Assignment

Clients may not assign their rights under this agreement. TaxPilot may assign rights with proper notice to clients.

Governing Law

This agreement is governed by Connecticut state law and federal tax regulations.
